Due to the various legality issues, the power to issue parking tickets has shifted from the police to the local councils which in turn have increased the number of such tickets issued to the motorists. As a result, many are resorting to parking ticket appeals in recent times.
There are arguments and scepticism regarding this huge amount of parking tickets. Many people claim that local Authorities and the subcontractors carry out collection of revenue fines just to increase their revenue and this is the reason behind the increase of parking ticket issuance year by year.
Moreover, owing to the huge increase in the parking fines, people are all the more resorting to parking fine appeals.
Since the local council representatives do not even turn up at appeal hearings and 50% of all motorists anyways win their appeals, it is a wise decision to appeal against a ticket which you feel was issued unfairly on you.
They do however serve a purpose. If no one was ever given one then there would be chaos on the high street. The local council will then have a much smaller budget for transport or will have no revenues since there will be no collection from the traffic fines which are a major income.
Hence, this is the theory behind the concept of parking tickets and parking fines. However, the reality seems to be slightly different with pressurized traffic wardens looking for ways to issue maximum no. of tickets so as to boost the local revenue.
For a motorist, parking in a public car park or a street when he is unsure of the place is not a good idea. You need to first look out for any signs or road markings that might be present nearby. If you are unsure, it is better not to park there rather than take the risk of being charged a huge parking fine and thereafter having to appeal the same.
Appealing against a parking ticket is actually not very hard. Despite this fact 99% of people still pay their parking fine. All it usually takes is just one simple letter to the local councils or if even one is lucky enough then even more a compact email..even easier.
So is it really too much hard work to write a simple email or even a letter to save yourself 30-120 pounds? Of course not. The problem is that many people feel this letter or email writing to be too difficult to attempt. There are however online companies who will do all the work for you. Some even provide you with a template letter or even make the appeal for you.
Photographic evidence works best while you strive to prove that the issued parking ticket is invalid. With the evidence, either you show that you didn’t commit the act or show that due to the non-existence of proper parking signboard you got confused and committed the offence. Moreover, since two-thirds of all tickets issued are illegal in nature, remember that the issuer has high chance of winning an appeal.
If you are going via the technicality way instead, try to focus on things that have been provided in the ticket itself. Hence, supposing you have got a ticket saying you parked wrongly at Smith Road and in reality you were in Smith Street, you might argue that the contravention never happened and thereby win your appeal.
Again there is yet another new phenomenon called private parking tickets. In this the ticket appears similar to what a traffic warden gives you only the distinction from normal ticket is it will say something like “Parking Charge Notice pay within 14 days for a reduced rate. Non payment will result in us contacting the D.V.L.A. for your details.”
But you really should not take any notice at all of these privately issued tickets. They have no legal basis. The tickets they issue are in fact invoices inviting you to pay. You do not legally have to! Do not even bother to contact them as they are likely to reply with a threatening letter.
To make my point more clear let me tell you one instance of a company called euro car parks where they have never taken anyone to court for non payment of parking fines.
If this company takes you to court, first and foremost they have to prove you as the registered keeper were driving the car at the time and entered the contract. (Entering their car park refers to entering a contract). Moreover, they need to prove that you were driving at that point in time and even if they are able to do all of these, what they will be entitled to is just a mere 2 pounds for an hours extra parking.
They might send you several threatening letters but just ignore them and never pay. Infact you can also threaten them in turn saying that you will take court action for such continuing harassment. You will see they will gradually disappear.
As with other parking ticket appeals never pay up until a ticket appeal service company gives you some technical assistance or useful advice.
